It is alleged that Kapil Mishra gave communal statements during the 2020 Delhi assembly elections. The High Court has issued a notice to the Delhi Police on the plea of ​​Kapil Mishra.

Kapil Mishra was ordered by Additional Chief Metropolitan Magistrate to appear. Kapil Mishra claims that no caste, community or religion was targeted on his behalf in his statements.

Delhi Assembly Elections 2020 and Hate Speech Case

Kapil Mishra, Pravesh Verma and then Union Minister Anurag Thakur were competing in the 2020 Delhi assembly elections. Then the transfer of Justice Muralidhar of the High Court was also questioned. Because, Justice S. Muralidhar had heard the case related to Hate Speech, and reprimanded the Delhi Police for not registering an FIR against such leaders. Just before the next hearing, Justice Muralidhar was transferred to the Punjab and Haryana High Court.

The Delhi Police had to listen to the reprimand for not registering an FIR for Hate Speech against the leaders.

Along with Kapil Mishra, Pravesh Verma became a minister in the Delhi government from the former MP, but Anurag Thakur has been kept out of the Union Cabinet. Kapil Mishra has also been a minister in the Aam Aadmi Party government before BJP. In 2020, despite all the tricks, Kapil Mishra also lost his election.

In early March 2025, the Delhi court rejected Kapil Mishra’s review petition, and the Delhi High Court has also done the same. Dismissing the petition, the court had said that Kapil Mishra used the word ‘Pakistan’ to spread hatred in his statements, and communal polarization to get votes in the election.

On behalf of Kapil Mishra, the court was told that no caste, community or religion was targeted on his behalf, but the court did not see any truth.

The court said, this argument is absurd and is completely unacceptable, the statement referred to a particular country… It was a clear indication to the people of a particular community, which was clearly to create enmity among religious communities. The court said, except for a sensible person, the common man can also understand this gesture easily.

The image of Kapil Mishra was being called to stop the trial in the court. Kapil Mishra’s counsel requested the Delhi High Court to stop the trial court proceedings, because if the court has completed the proceedings to framing the charges during this time, it can cause serious damage to Kapil Mishra’s image.

Advantage or disadvantage to Kapil Mishra

Due to Kapil Mishra getting caught in the legal trouble, the challenge may arise in front of Delhi Chief Minister Rekha Gupta.
