The court acquitted co-accused Sanjay Ferratlal Gautam in this case citing lack of decisive evidence against him. A copy of the order passed on Thursday was made available on Saturday. Additional government lawyer Rekha Hivrale said that on July 27, 2016, the victim Jai Prajapati went missing after telling his father that he was at Bhayandar railway station. After this, his father’s ransom message was received.
He said that messages were sent from Jai Prajapati’s mobile phone, in which a demand of Rs 15 lakh was made for his release. However, despite the efforts of his family and police, the victim could not be traced. After some time, his body was found wrapped in a motorcycle cover in Mangrove. The prosecution said that through forensic investigation and digital evidence, the police arrested the accused Ajay Vishwakarma.
The government lawyer said that during the trial, at least 16 prosecution witnesses, including the family members and medical officers of the victim, were investigated. The court said that the witnesses of the main prosecution testified after a delay of six years, causing some discrepancies. However, the judge said that small discrepancies should not reduce the credibility of evidence. The prosecution failed to prove the demand for ransom.
However, the prosecution successfully proved that Ajay Vishwakarma had the aim of killing Jai Prajapati due to personal enmity. At the behest of the accused, the recovery of the dead body and confession in front of the witness played an important role in ensuring conviction. The judge said in his order that the case does not fall in the ‘rare to the rarest’ category, for which death penalty should be punished.
