The Supreme Court on Tuesday has taken cognizance of the Allahabad High Court on March 17 in a case related to the rape attempt with a minor girl. Tomorrow (Wednesday), the bench of Justice BR Gawai and Justice Augustin George Christ will hear this issue.

What was the decision by Allahabad court?

The Allahabad High Court had said in its judgment that due to the allegations of catching the victim’s breast, and breaking the pulse of the pajamas, it would not have become a case of rape attempt against the accused. Judge Justice Ram Manohar Narayan Mishra, who gave the verdict, said that after recording the facts of this incident with an 11 -year -old girl, it was said that due to these allegations, it becomes a case of trauma on the dignity of the woman. But cannot call it an attempt to rape.

The Supreme Court on Monday refused to hear the PIL filed on the Allahabad High Court’s decision. It was demanded in the petition that the court should direct the Central Government and the Registrar General of Allahabad High Court to remove this disputed part of the decision and repair it in the records.

The Allahabad High Court ordered the accused to prosecute the accused under Section 354B of IPC and Section 9/10 of Poxo Act. There was a lot of opposition to this disputed decision. Many lomers had demanded the Supreme Court to take automatic cognizance of this decision.
